The first studies in Philosophy that studied digital technology did not specify the characteristics of its various technical applications or instruments. They looked at the virtual reality and used the metaphor of immersion to study the set of all technological developments, as had been done before with the novel. Thus, Internet is misunderstood by many experts as virtuality (next to Baudrillard), rather than linking its hypertext system closer to other theories like those proposed by Deleuze and Guattari or Bourriaud.

La autonomía del arte es un punto de partida común para forjar una significación para el arte de vanguardias. Con ella, los manifiestos y estudios críticos apuntan lecturas epistemológicas y sociales, que parten necesariamente de una reflexión desde la ontología, sobre la naturaleza de ese arte. Pero Ortega se queda sólo en lo ontológico para hacer del arte una entidad de naturaleza radicalmente distinta a la realidad del espectador. Porque lo que pretende es hacer orbitar también el arte -con las (...) vanguardias (desde la autoconciencia de autónomas que él les supone)- en torno al eje de su filosofía, como mecanismo de evasión de la realidad radical que es para cada individuo su propia vida. El objetivo de este trabajo es proporcionar razones a favor de la teoría jurídica computacional como una nueva área de la teoría jurídica contemporánea. El trabajo inicia con una breve panorámica de la historia de la inteligencia artificial con el fin de contar con una estantería que permita ubicar los distintos acercamientos que pueden darse en el terreno de la inteligencia artificial aplicada al derecho (IAD): los correspondientes al enfoque top-down y al bottom-up. Después de una enunciación de los temas (...) de interés por parte de la comunidad internacional de IAD se exponen algunos desarrollos con referencia especial a los realizados en el Laboratorio de Constructivismo Jurídica del Instituto de Investigaciones Jurídicas de la Universidad NacionalAutónoma de México en los que se resalta el papel de la teoría jurídica computacional: los proyectos EXPERTIUS I, EXPERTIUS II y el Sistema inteligente para la configuración y visualización del derecho globalizado como una red adaptativa compleja emergente. My aim in this comment is to provide reasons that highlight the importance of the Spanish translation of Brian Bix’s book: “Jurisprudence, Theory and Context”. My comment stems from the sociology of knowledge and takes as a point of departure an empirical study about the state of the art of legal philosophy in Mexican Law Schools. My conclusion is that Brian Bix’s work shows how Mexican legal philosophy might be incorporated into current jurisprudential debate.Resumen: El objetivo de este comentario es (...) proporcionar algunas razones a favor de la importancia de la publicación de la traducción al español del libro de Brian Bix “Jurisprudence, Theory and Context” para la actualización de la filosofía del derecho en México. Mi comentario es realizado desde la perspectiva de la sociología del conocimiento y tiene como punto de partida un estudio empírico sobre el estado del arte de la filosofía del derecho en las facultades de derecho del país. Mi conclusión es que el trabajo de Brian Bix responde la pregunta fundamental: ¿cómo incorporar a la filosofía del derecho mexicana al contexto global?, que estudiantes, profesores y jóvenes investigadores se plantean actualmente. In this paper I argue against the thesis defended by Michael Giudice, who claims that it is possible to provide a concept of law by determining the necessary conditions of its essence. My main thesis is: 1) that this goal can exclusively be reached with certain kind of concepts: those satisfying what I propose to call:“Golden Standard of Concepts with Necessary Conditions” and 2) that the concept of “Law” is not such a concept. Therefore I defendmethodological pluralism in opposition to (...) methodological monism embraced by some contemporary legal philosophers.Resumen:En este artículo contiendo la tesis defendida por Michael Giudice en la cual sostiene que es posible elaborar un concepto de derecho mediante la determinación de las propiedades necesarias de su esencia. Este artículo propone reunir a la literatura y la filosofía en un mecanismo didáctico para estimular la práctica de la filosofía con la lectura y la escritura de relatos, con los postulados del constructivismo, en torno a hacer filosofía, no solo observarla desde fuera. Parte de dos premisas: 1) el cuento moderno funciona como pregunta filosófica, como presentador de los grandes temas filosóficos, pero 2) evita la tentación de una explicación explícita, que queda elidida, para que sea el lector quien (...) acabe dándole una forma definitiva con su interpretación, participando en la construcción de su significado. Ortega, aunque comprime su metafísica hasta formularla con su “Yo soy yo y mi circunstancia”, no escribe apenas de esa circunstancia: de su condición y posibles aspectos. Del binomio con que explica la vida trabaja solo en la reacción del individuo, convertida su propuesta metafísica en una ética que confía en las fuerzas del sujeto para desarrollar su proyecto vital en cualquier entorno. Aún es de día, que publica Miguel Delibes en 1949, con la España de posguerra de fondo, puede (...) leerse como una réplica a esta ética que Ortega llama de la ilusión: Su protagonista, ante una circunstancia abiertamente hostil, es incapaz de desarrollar el programa que quiere para su vida. La trama funciona como planteamiento de una ética que recalcula las posibilidades del individuo para realizarse en un entorno adverso. (shrink)

Ortega presenta su metafísica como un sistema de imágenes alrededor de la novela como metáfora de la vida. Pero confunde el sujeto y el objeto referenciales en su explicación de la vida como acción, porque previamente no ha trabajado lo suficiente en su estética el personaje. Zambrano, en cambio, sí tiene una reflexión propia del personaje que le permite moverse mejor en la analogía, verle más aspectos. Por ejemplo, el envés desde la ética de la condición de proyectivo del hombre (...) : para Zambrano una actitud reprobable como comportamiento buscado, el sacrificio de la vida a un esquema preconcebido reductor. Ethical banking, microfinance institutions or certain credit cooperatives, among others, grant socially responsible loans. This paper presents a credit score system for them. The model evaluates social and financial aspects of the borrower. The financial aspects are evaluated under the conventional banking framework, by analysing accounting statements and financial projections. The social aspects try to quantify the loan impact on the achievement of Millennium Development Goals such as employment, education, environment, health or community impact. The social credit score model should (...) incorporate the lender’s know-how and should also be coherent with its mission. This is done using Multi-Criteria Decision Making. The paper illustrates a real case: a loan application by a social entrepreneur presented to a socially responsible lender. The decision support system not only produces a score, but also reveals strengths and weaknesses of the application. (shrink)

Decolonial, postcolonial, and postmodern criticism is indebted to Frantz Fanon for revealing the hegemony of vision and visual language in Western imperial discourse. Yet, the import of Fanon's critique of coloniality reaches beyond a focus on vision into the sonorous. Attending to the often overlooked auditory dimension of Fanon's work, I argue, brings attention to the role of listening as a condition of possibility of a revolutionary consciousness. Listening to Fanon's careful descriptions of the experience of many Algerians of listening (...) to the National Liberation Front's radio broadcast, The Voice of Free and Fighting Algeria in “This is the Voice of Algeria,” I propose that what makes possible the institution of a revolutionary consciousness is listening to murmurs. Listening to the materiality of voice and sound rather than the propositional content of speech is revolutionary because it challenges core values central to the project of colonial modernity: metaphysical logocentrism and the fungibility to which colonial modernity strives to reduce colonized subjects. Differences in Common engages in the ongoing debate on ‘community’ focusing on its philosophical and political aspects through a gendered perspective. It explores the subversive and enriching potential of the concept of community, as seen from the perspective of heterogeneity and distance, and not from homogeneity and fused adhesions. This theoretical reflection is, in most of the essays included here, based on the analysis of literary and filmic texts, which, due to their irreducible singularity, teach us to think without being (...) tied, or needing to resort, to commonplaces. Philosophers such as Arendt, Blanchot, Foucault, Agamben or Derrida have made seminal reflections on community, often inspired by contemporary historical events and sometimes questioning the term itself. More recently, thinkers like Judith Butler, Gayatri Spivak or Rada Ivekovic—included in this volume are essays by all three—have emphasized the gender bias in the debate, also problematizing the notion of community. Most of the essays gathered in Differences in Common conceive community not as the affirmation of several properties which would unite us to other similar individuals, but as the “expropriation” of ourselves (Esposito), in an intimate diaspora. Community does not fill the gap between subjects but places itself in this gap or void. This conception stresses the subject’s vulnerability, a topic which is also central to this volume. The body of community is thus opened by a “wound” (Cixous) which exposes us to the contagion of otherness. The essays collected here reflect on different topics related to these issues, such as: gender and nation; nationalism, internationalism, transnationalism; nationalism’s naturalization of citizenship and the exclusion of women from citizenship; the violent consequences of a gendered nation on women’s bodies; gendering community; preservation of difference(s) within the community; bodily vulnerability and new politics; community and mourning; community and the politics of memory; fiction, historical truth and (fake) documentary; love, relationality and community; interpretive communities and virtual communities on the Web, among others. Esta obra se abre con una introducción histórica, no heleno ni eurocéntrica, en la que se reinterpretan los sistemas éticos en la historia mundial, hasta situar la problemática en la Modernidad dentro del sistema-mundo como proceso de globalización que simultáneamente excluye a la mayoría de la humanidad. En la primera parte se aborda una crítica a las morales formales (Kant, Rawls, Apel, Habermas) desde un principio material o de contenido con pretensión de universalidad; el deber de producir, reproducir y desarrollar (...) la vida humana en comunidad. El principio de factibilidad ética, por su parte, permite que el cumplimiento del acto, institución o sistema de eticidad pueda tener la pretensión de bondad. En la segunda parte, desde la imposibilidad de que dicho acto, institución o sistema de eticidad «buenos» pueda tener pretensión de perfección acabada, se descubren los que «sufren» en su corporalidad vulnerable la imposibilidad de vivir, el hecho de ser excluidos. Se trata de las víctimas, al decir de Marx, Horkheimer, Benjamin, Nietzsche, Freud o Lévinas. Desde las víctimas comienza propiamente el discurso de la Ética de la Liberación, en su nivel negativo material (deben poder vivir), en el principio discursivo crítico (deben poder participar en la argumentación), todo lo cual culmina en el principio crítico negativo de la factibilidad: el principio-liberación que inspira las transformaciones con pretensión de justicia. Different theoretical models have proposed cognitive and affective components in empathy and moral judgments encompassing compassion. Furthermore, gender differences in psychological and neural functions involving empathic and moral processing, as well as compassionate experiences, have been reported. However, the neurobiological function regarding affective and cognitive integration underlying compassion and gender-associated differences has not been investigated. In this study, we aimed to examine the interaction between cognitive and emotional components through functional connectivity analyzes and to explore gender differences for the recruitment (...) and interaction of these components. Thirty-six healthy participants were exposed to social images in an fMRI session to judge whether the stimuli elicited compassion. The results showed a different connectivity pattern for women and men of the insular cortex, the dorsomedial prefrontal cortex, the orbitofrontal cortex, and the cingulate cortex. The integration of affective and cognitive components follows a complex functional connectivity pattern that is different for both genders. These differences may indicate that men largely make compassionate judgments based on contextual information, while women tend to notably take internal and introspective processes into account. Women and men can use different affective and cognitive routes that could converge in similar learning of moral values, empathic experiences and compassionate acts. (shrink)

Drawing on the hypothesis that workplace harassment may be considered a genre of negative communication serving malicious purposes, the purposes of this paper are threefold. In the first place, we consider the difficulties involved in proving workplace harassment before administration or in court. In the second place, we analyse the challenges workplace harassment poses to linguistic analysis, with special reference to genre theory, and suggest ways of making the theory compatible with the new linguistic input the language of harassment provides. (...) Finally, we illustrate the knowledge the expert linguist can offer from the perspective of genre theory in cases involving workplace harassment. In order not to build a castle in the sky, our analysis is grounded in an exemplary case study relating to a specific type of harassment in the workplace that Leymann named « workplace mobbing ». We offer a critical survey of the most discussed accounts of epistemic peer disagreement that are found in the recent literature. We also sketch an alternative approach in line with a pluralist understanding of epistemic rationality.

En este libro, que aparece en Italia en 1987, publicado muchas veces y muy comentado también en el extranjero, Vincenzo Ferrari analiza las funciones sociales del derecho en una perspectiva relativista, subjetivista y conflictualista, opuesta a la del funcionalismo sociológico. De tal manera, el derecho se revela como un medio de acción social dirigido a lograr los proyectos de seres humanos empeñados en relaciones variables de cooperación y de lucha. Así, se muestra cómo las normas jurídicas pueden orientar las (...) actitudes y desorientarlas; solucionar los conflictos y agravarlos o fomentarlos; legitimar cualquier forma de poder con argumentos tan válidos como ficticios. ArgumentThis paper analyzes the political dimension of Miguel Masriera's (1901–1981) science popularization program. In the 1920s, Masriera worked at the Swiss Federal Institute of Technology (ETH) in Zurich – with Hermann Staudinger, the luminary of polymer chemistry – to later become a lecturer of theoretical and physical chemistry at the University of Barcelona. After living in exile in Paris, at the end of the Civil War he returned to Spain but never recovered his position. Instead, Masriera became an active popular (...) science writer and adapted to the severe constraints of General Franco's military dictatorship (1939–1975). Inspired by the astronomer Arthur Eddington's world view, Masriera wrote and translated popular science books, and published articles in daily newspapers and journals. By examining Masriera's popular works, in particular his program for spreading “atomic culture” in Spain during the Cold War, this paper aims to contribute to the assessment of the role of science popularization in the domestic legitimization of that dictatorial regime and also its use as a vehicle for international recognition abroad. According to the form of logical pluralism elaborated by Beall and Restall there is more than one relation of logical consequence. Since they take the relation of logical consequence to reside at the very heart of a logical system, different relations of logical consequence yield different logics. In this paper, we are especially interested in understanding what are the consequences of endorsing Beall and Restall’s version of logical pluralism vis-à-vis the normative guidance that logic is taken to provide to reasoners. (...) In particular, the aim of this paper is threefold. First, in Sections 2 and 3, we offer an exegesis of Beall and Restall’s logical pluralism as a thesis of semantic indeterminacy of our concept of logical consequence – i.e. understood as indeterminacy logical pluralism. Second, in Sections 4 and 5, we elaborate and critically scrutinize three models of semantic indeterminacy that we think are fit to capture Beall and Restall’s indeterminacy logical pluralism. Third, in Section 6, following Beall and Restall’s assumption that the notion of logical consequence has normative significance for deductive reasoning, we raise a series of normative problems for indeterminacy logical pluralism. The overall conclusion that we aim to establish is that Beall and Restall’s indeterminate logical pluralism cannot offer an adequate account of the normative guidance that logic is taken to provide us with in ordinary contexts of reasoning. The aim of this paper is to explore the peculiar case of infectious logics, a group of systems obtained generalizing the semantic behavior characteristic of the -fragment of the logics of nonsense, such as the ones due to Bochvar and Halldén, among others. Here, we extend these logics with classical negations, and we furthermore show that some of these extended systems can be properly regarded as logics of formal inconsistency and logics of formal undeterminedness.

Partimos de unas reflexiones sobre el Racionalismo y el Historicismo como dos enfoques con perfiles epistemológicos claramente diferenciados, que llevan a quien en ellos se sitúe a muy diversos planteamientos respecto a cualquier cuestión de carácter social. Examinamos el alcance y potencial de ambos en su argumentación cuando pretenden dar cuenta del origen de la sociedad política y todo lo que ello representa, instituciones, valores… Esbozada esta cuestión se recala en el análisis jovellanista de la mujer. Jovellanos conoce bien ambos (...) enfoques, sus lecturas de los autores aquí citados están plenamente contrastadas y no son objeto de este trabajo; apuesta por el enfoque historicista inglés para comprender el rol femenino, para situar a las instituciones que le niegan su ingreso en su decurso histórico, y curiosamente convierte el modelo historicista en una vía de análisis y acceso a propuestas de una extraordinaria modernidad. Analizamos desde estos enfoques los planes de estudio en los que estamos inmersos. (shrink)
